These Terms & Conditions ("Terms") govern your access to and use of IX Baseball (the "Service"), operated by IX Baseball ("IX Baseball", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. Who you are contracting with

The Service is provided by IX Baseball. You must be at least the age of majority in your jurisdiction to create an account. Parents or legal guardians may create linked athlete profiles for minors and are responsible for all activity under those linked profiles. Coaches and organization administrators warrant that they have authority to bind the team, academy, school, or organization they represent.

2. Acceptance of these Terms

By continuing to use the Service after these Terms are posted, you accept them. If you do not agree, you must stop using the Service.

3. The Service

IX Baseball is a player development platform for baseball athletes, coaches, families, teams, academies, training facilities, schools, and organizations. The Service includes video upload and storage, AI-assisted swing and pitching analysis, HittingIQ and Transfer Score assessments, coach reviews, drills, training plans, practice builders, team and organization dashboards, parent dashboards, and related tools. Features available to you depend on your role and subscription plan.

4. Account and credentials

  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • You must promptly notify us at team@ixbaseball.ca if you suspect unauthorized access.
  • You must be at least the age of majority in your jurisdiction to hold an account that controls athlete data.

5. Acceptable use

You agree not to misuse the Service. You will not:

  • Use the Service for any unlawful, fraudulent, harassing, abusive, or discriminatory purpose;
  • Upload content you do not have the right to share, or that infringes anyone's intellectual property, privacy, image, or likeness rights;
  • Upload videos or images of athletes without the parent's or guardian's authorization;
  • Attempt to probe, scan, or breach the security of the Service, interfere with other users, or circumvent technical controls;
  • Scrape, crawl, reverse engineer, or attempt to extract source code, except as permitted by law;
  • Resell, sublicense, or share access to paid features outside the scope of your plan;
  • Upload malware or any code intended to damage, disrupt, or gain unauthorized access;
  • Use the Service or AI-generated outputs to harass, demean, or publicly evaluate athletes outside of the platform's intended development purpose.

6. User content

You retain ownership of the videos, notes, assessments, and other content you upload. You grant IX Baseball a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content solely to operate, secure, and provide the Service to you and the users you are authorized to share with (for example, generating reports, enabling coach reviews, sharing with coaches and organizations the athlete is assigned to, and providing playback). We do not sell your content. We do not use your videos or athlete data to train third-party AI models.

7. AI-assisted features

Parts of the Service generate reports, scores, cues, and drill recommendations using AI models. AI outputs are decision support and may contain errors or omissions; they do not constitute medical, performance-coaching, recruiting, or scouting advice and should not be used as the sole basis for any decision affecting an athlete's health, training load, or recruiting status. Coaches and parents remain responsible for the decisions they make. See our Privacy Notice for details on how AI processing is performed and your right to opt out.

8. Intellectual property

The Service, including its software, design, branding, drills library, lesson content, HittingIQ, Transfer Score, coaching frameworks, and trademarks, is owned by IX Baseball or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with your plan and these Terms. No other rights are granted by implication.

9. Coach, team, and organization responsibilities

  • Coaches and organization administrators must only invite, enroll, or upload data for athletes whose parent or guardian has authorized that participation.
  • Organizations are responsible for managing their own roster, coach assignments, and the lawfulness of access they grant to their staff. The terms governing IX Baseball's processing of organization-controlled data are set out in our Organization Data Processing Addendum.
  • Independent coaches are bound by our Coach Data Processing Addendum when they access parent- or organization-controlled athlete data.
  • Coaches may not use athlete videos, reports, or personal data outside IX Baseball without the explicit consent of the parent or guardian.
  • Coaches and organizations must not use the Service to publicly grade, rank, or share athletes outside the platform without consent.

10. Payments, subscriptions, and billing

Paid plans renew automatically until cancelled. Prices are shown on the pricing page and are charged in the currency displayed at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all orders. Paddle handles all payment processing, subscription billing, tax compliance, invoicing, customer-service inquiries related to payments, and refunds. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms in addition to these Terms and our Refund Policy.

11. Cancellations

You can cancel a monthly subscription at any time from your account settings or via paddle.net. Cancellation takes effect at the end of the current billing period. You will continue to have access until then.

13. Service availability and warranties

We work hard to keep the Service running smoothly but we do not guarantee that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs are provided without warranty as to accuracy or completeness.

14. Limitation of liability

To the fullest extent permitted by law, IX Baseball will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, recruiting outcomes, scholarship outcomes, or other intangible losses. Our aggregate liability for any claim arising out of or related to the Service is limited to the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, death, or personal injury caused by negligence.

15. Indemnity

You agree to indemnify and hold IX Baseball harmless from any claims, losses, or expenses arising from your content, your use of the Service, your breach of these Terms, or, in the case of coaches and organizations, your processing of athlete data outside the scope of authority granted to you by the parent or guardian.

16. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if:

  • You materially breach these Terms;
  • Your account is in non-payment;
  • We reasonably believe your activity creates a security, legal, or fraud risk to us, other users, athletes, or third parties;
  • You repeatedly or seriously violate our acceptable-use rules;
  • A coach or organization is processing athlete data without proper authorization.

You may terminate your account at any time. On termination, your right to use the Service ends. You may export your reports before termination. We may retain limited data as required by law or to resolve disputes (see Section 8 of the Privacy Notice).

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.

18. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws rules. The courts located in Ontario will have exclusive jurisdiction over any disputes, except where prohibited by applicable consumer law.
